High court backs elderly housing

The state Supreme Court has upheld Newmarket’s elderly housing zoning ordinance.

The ruling brings CCW Management of Concord one step closer to constructing a 57-unit elderly housing project on a nine-acre site at 292 Wadleigh Falls Rd.

Abutters had appealed a 2003 zoning board decision, claiming it was vague and constituted spot zoning. A lower court backed the decision.

The town Planning Board approved CCW’s proposal in the spring, and abutters subsequently challenged that vote in Rockingham Superior Court. A hearing was held in August. No decision has yet been announced.
