A Merrimack condominium association charges that a Massachusetts company botched a major roofing job several years ago, leading to leaks.
The Harris Pond Condominium Association filed suit last month in Hillsborough County Superior Court against WDC Development Co. of North Chelmsford, Mass., charging the company with negligence and breach of contract and warranty.
The association hired the company to replace roofs on 14 of its 22 buildings in 1999, the suit states.
Three years later, after some of the roofs started to leak, inspections revealed that no underlay material had been used on dormers, waterproof membrane had not been laid over all of the roof areas, and rain diverters and flashing was improperly installed, the association claims.
WDC has until next month to respond to the suit, and has yet to do so.
