City objecting to Pennichuck's appeal

The city of Nashua filed an objection Wednesday to Pennichuck Water Works’ request for a rehearing in the ongoing eminent domain case. The water utility company’s appeal, filed last week, alleges state regulators made 18 errors in a July 25 order allowing Nashua to seize the company for $203 million.

The city’s objection rebuts all 18 claims, including that the state Public Utilities Commission misinterpreted the state’s eminent domain law and failed to consider the broader implications of a takeover for the company, state and customers who don’t live in Nashua.

If Pennichuck’s request for a rehearing with the PUC is rejected, the company plans to appeal the case to the state Supreme Court.
